Contract Obligations

My Sister and I were Power of Attorny for my mother. She lived in Florida and became sick, went to the hospital and then release to Ponce De Leon Health Care Center. My sister and I were not available and my wife was visiting my mother. A day after my mother was admitted and the same day my wife was flying home to Michigan, Ponce Care Center told my with that they needed her to sign the admission form and said it was only a formality and they would have my mother sign them later. Ponce now is sueing my wife for $4165.99, the remainder of the bill after Medicaid and Medicare paid $153,960.42 on a bill of $155,459.70.

What options do we have

I'd try negotiating with them. If that doesn't work, then get a lawyer where Ponce is located to try to deal with them. By going over the invoice in detail you may find that they owe money back to the government.

I believe your real question is whether or not your wife is responsible for the debt. Under Florida law, she probably is if she signed the paperwork in her individual capacity.

As other attorneys have previously suggested to you, it may prove worthwhile to have the paperwork and billing carefully reviewed. At the least, an attorney may be able to negotiate a lesser amount to be paid if not get the entire debt waived.
