Legal Question in Civil Litigation in Florida

My daycare,Davenport School & bus driver are being sued..i dont know what I shou

I run a family daycare in my home.Last yearthe school bus driver had a child asking to get off at my place.Since no one was at the childs home , the driver kept the child on the bus. Knowing that I take care of so many children{for several years}AND child stayed w/me last year I told driver I`d keep the child and get ahold of her father, who lives just down the road from me.After saeveral hours, contuously calling Finally I took the child home.

Then, I guess the father wrote a letter to the newspaper about neglegence of bus dr. & school.(His opinion.)

At the end of the year, his child failed the grade, and he`s blaming the school for failing the child because of the LETTER he wrote about them. AND is now suing ALL of us involved in that day. I thought it would get thrown out,but not . They want me to write out my side of the story.I dont want tohurt me or my business or make my insurance upset....or somehow INCRIMINATE myself..I thought I was helping as was the driver and so on..Shouldn`t they send me questions to answer...instead of me writing my story? and should I counter sue or something? Please help me to know what to do.

Thanks, S. --name removed--

You need to immediately notify any insurance carrier providing insurance coverages that might possibly cover the claim made against you and/or your company, with a copy of the complaint made against you. If there is coverage, the carrier should provide you with legal counsel to defenhd your interests. Until you consult with your attorney, I would refrain from making any statements in the case as they may come back to haunt you. It appears that time is of the essence so quickly contact your insurance carrier and/or get yourself an attorney to defend the claim and investigate whether you have a legal basis to file a counterclaim, crossclaim or third-party claim. Good luck.
