Legal Question in Civil Litigation in Florida
Debt Collector gone mad
In the state of florida I had a debt collector call me today. That did not state that they were in attempt to collect a debt, they also did not state the the conversation was being recorded until I forced them to tell me. They also run a credit report to see if I had any available credit to pay my debt. Are they in any violation of laws?

From the facts presented, he/she seems to have violated several laws under the Fair Debit Collection Practices Act. A debt collector cannot be deceiving and must identify themeseves. Further, Florida law prohibits the recording of any telephone conversation unless the other party has knowledge and agrees. It is illegal to do so otherwise and a violation of criminal statutes.
