Defrauded by personal trainer for $5,000
What are my options? I was asked by my personal trainer (who operated his own private facility) to (1) pay the next block of training sessions in full, and (2) to pay an advance on another blcok. I agreed to both. As soon as the check cleared -- but not before -- he told me he was facing eviction. He was evicted and has bounced from one PUBLIC gym to another, and won't return my money. He seems to think this about nothing more than 'remaining sessions to be carried out anywhere he happens to wind up working''. I paid for HIS private facility. Further, I feel that he's committed fraud by requesting this money without telling me the issues. Please tell me what legal options I have, how I can pursue this, and what - if any - laws/rules he has broken. Thank you.

This depends on what your agreement was with him. I suspect nothing is in writing so it is your word against his. You assuned, reasonably, that the PT would be at a private location, but if that was not expressly stated you may be out of luck.
