Diminished Value - LIVE IN FLORIDA. ACCIDENT HAPPENED IN FLORIDA Rear ended by vehicle while waiting for stop light. My vehicle was 87 days old. Driver of that vehicle was ticketed for careless driving. Hired an expert appraisal to determine diminished value amount. Auction value before crash minus auction value after crash $6000. His insur. co. offered $1600. for Diminished Value. Refused to discuss method used to arrive at 1600 dollar amount. Vehicle DID suffer unibody damage. DO I SUE THE DRIVER OR HIS INSURANCE COMPANY??? Car dealers do not want the vehicle, will take directly to auction.

Technically you sue the driver. But you don't want to do this type of case yourself. You need to speak with a Florida attorney that handles insurance cases.
