This is just another version of a similar question you asked. It will be up to the court to determine who gets the monies - and most likely the court will require that the repairs that were covered under the insurance will have to be made.

Read the policy. Usually, the policy beneficiary, unless there is a paid up condition.

Insurance benefits from what? If there was a fire, for instance, the mortgagor generally gets the payment first. Read, the mortgage agreement, however, it will give you the answer. If the insurance payment is for something that is not related to the house, then the mortgagor has no right to the payment, but you still owe the money of course.
