if your spouse leaves you without a legal seperation and is dating someone else, can you use that against them when determining what they deserve financially.

There is no such thing as a legal separation in Florida. Assets earned during a marriage are shared evenly either by and between the parties through a property settlement agreement or the court will make a distribution along these lines. Assets brought into the marriage generally belong to the person who brought that asset in unless a gift was given to the other party.

In Florida, there is no such thing as a "legal separation" as there is in some states. Florida is a no faukt state, so leaving you and dating someone else does not affect what is owed, if anything.
