Legal Question in Civil Litigation in Florida

Hello, a next door neighbor has about seven or eight large “exotic” birds that he keeps in very small cages in an outside shed within feet of my house, next to the property line. I don’t know much about birds but guess these caged animals are parrots, macaws, etc. They screech constantly at all hours and sometimes for hours straight, and make it impossible to enjoy otherwise pleasant days in my home. The owner does nothing to stop the noise and I’ve stopped asking him to quiet those screeching animals as he cursed me out the last time. This individual drinks considerably, is every bit a worst neighbor possible, and plain obnoxious.

This neighborhood is in city limits and I have contacted both animal control and the city about the situation. Police officers and an animal control have investigated but have provided no permanent solution and I was told that although these animal are kept in small cages they have food and water so are not being abused. And, although the noise is a violation, it is no different that somebody having a bunch a barking dogs that they will not control and there is little an officer can do about it, and if they are not making noise when officers stop by then there is nothing they can do about it.

Can anybody tell me, from a legal perspective, if there is anything I can do about this situation? I am simply at wits end as the screeching makes an otherwise enjoyable home absolutely miserable, day in and day out.

Gather your police reports and seek a lawyer who will file write for injunctiive relief. It will be costly and you will have to testify.
