Driving someones car...car dies...owner gets in...car starts...I pay for new eng
A friend purchased a 95 Bmw from a used car dealership with 50 thousand miles on it, he modifies the exhaust system and drives the vehicle hard (witnesses to this action). He comes to my house 3 weeks later for some help so I agree, he needs some parts, so he gives me the keys and says that I can drive. I'm pulling out of my neighborhood on to highway, I get to third gear 65mph, and go to put it in 4th gear, and the shifter didn't get into gear, and my foot was already pressing the gas as if I were in the gear, and the car hit the rev limiter and cut off, like as if you had just turned the key, no bangs, clunks, smoke, just cut off...I pull over..he gets in the car, the car starts up, he is reving the engine between 3k to 5k rpms,everything sounds perfect, he lets off the gas, the car dies again, he calls a tow truck, three days later, they slap me with a lawsuit saying I owe 3500 for a new motor. How can I be 100% guilty if the motor started with him and died with him for good..Would they not have to prove that? and how would they prove it was me over him? We have offered them 1200dollars to keep it out of court and they declined
