Legal Question in Civil Litigation in Florida
Duval County, Jacksonville Florida
A dispute between neighbors resulted in one calling the police on the other claiming threats were made. This occurred due to an incident that happened two weeks earlier. Complainant/victim (male) entered suspects (male) property without permission (trespassing), suspects wife questionned him and he began to berate her with profanities and insults on her property. Suspect waited two weeks before seeing complainant and confronting him while on suspect's own property about how he spoke to his wife and entered his property. No threats were made. Responding officer spoke to all parties involved, complainant and witness vs. suspect and two witnesses. No arrest was made. Complainant demanded documentation so officer provided him with a State Attorney office intake card.
Can the complainant/victim proceed with the State Attorney office?
What is the likelihood of charges/prosecution being brought against suspect at a later time?
1 Answer from Attorneys
Yes.
Chances that the SA will pursue are pretty small. No one was hurt, it is a swearing match as to what happened, and it probably is not worth the time to prosecute.
