Legal Question in Civil Litigation in Florida

Exparte Hearing for a Deafault request

I was summoned on the 17th Nov 04 I have responded twice to the summons via certified mail once requesting an extension to respond and 2nd requesting time to review accusing documentation. The plaintiff's attorney is going to have an exparte hearing next week. The court says it is very brief and that the judge doesn't really take stsameents. But that they are showing my resposne and do not think a default will be granted. Should i go to the Exparte hearing? Can the judge grant this request and not take in consideration my letters?

Thank you!

Re: Exparte Hearing for a Deafault request

If you want to play roulette at the casino, then you better know the rules. Simillarly, if you want to play at the courthouse, you better know the rules, otherwise you run the risk of losing by a technicality. Based on the facts that you have provided there is no way to tell what may happen. You need to hire a local attorney to review the pleadings, and I recommend you do it immediately to preserve your rights. Good luck!
