Legal Question in Civil Litigation in Florida
false arrest
what if I had a client who went into a retail store, and on his way leaving, an officer sees that he has sunglasses on his head and the tag is still on them so he restrains the customer under false pretenses once he find out that the sunglasses are his and the tag was hanging from his new wig. Does my client have a case against the store owner?

Re: false arrest
Was the officer your employee?
How was he "restrained?" If he was locked in a room for hours, perhaps so. If he was simply detained, asked about the tag and then allowed to go on his way, then probably not -- or at least not enough to worry about.
