Family member refuses to pay.

A few months ago, I closed my business and made an oral agreement with my brother to sell my tools to him. We made an agreement that he would make monthly payments and have the balance paid in full by April. To date, he has not paid anything and refuses to take my calls. He has the tools and will not tell me where they are so I can pick them up. He keeps telling me that I will get my money but has made no attempt to pay. Can I report him for theft? I keep asking for either the money or the location of the tools. What can I do? His girlfriend helped remove the tools from my office.Can she also be held responsible?
