Legal Question in Civil Litigation in Florida

Someone filed a false police report against my husband for theft. My husband was not in any way involved. The golf cart in question was never stolen. We both feel terrible and are not happy that everyone knows about this. We live in a small camping resort and it's like a grapevine. We helped this persons' father get into an assisted living facility and cleaned up the mess his daughter left of his trailer. She knew exactly where the golf cart was and that it was not stolen. The daughter lives in New York State and we live in Florida. Do we have any recourse.

If a person knowingly and falsely accused you of committing a crime, this is slander and is actionable. You will have to prove that she knew that it was false and acted with malice, and that you were harmed, at least emotionally, by the statement.

I suggest you contact a New York lawyer in the city where this person lives. Whether a lawyer decides to take the case depends on whether he or she will get paid for the work. Does the person have funds to collect from or pay a judgement? Does she own a home and have homeowners' insurance which may cover the claim. Can you pay an hourly fee and the costs associated with such a claim? Is it worth the cost and effort?
