filing a lien against a party with a power of attorney
I would like to file a judgement lien against my ex for back child support. He owes $40,000+. An attempt to modify child support was filed by his parents whom he gave power of attorney to before he went to prison for 5 yrs. The case was essentially put on the back burner until he is released. I can only file $5000 at a time in small claims court. When filing do I also serve his parents? And assuming the said lien is granted are his parents then liable for the debt? Is small claims even the best route for this? I would have to file multiplle times to ensure that what was owed before his incarrceration was not wiped away after his release. Can you help?

This is not something that can be handled in family court.
If you contact the Department of Children and Families in Tallahassee they have a procedure where they will -- free of charge to you -- chase down the spouse owing child support. Contact them right away. You can get contact information at myflorida . com
