gated entrance malfuntion

Is the community liable for car damage when the gate malfunctions? I did call the police and file a report, but the officer said that I would have the burden of proof to get them to pay. Is this true? I took pictures, and everyone on the community knows that the gates never work correctly. Please advise. Thank you.
