Does a breach of fiduciary duty by a bank and legal counsel of a business owner and investor constitute a violation of civil rights. What is the best area in which to bring an action -- as civil rights violation ?

Generally, No. A breach of fiduciary duty constitutes just that, a breach of fiduciary duty, which itself is a recognized cause of action under which you may be entitled to pursue and recover money damages. You may also have other causes of action such as (a) breach of contract, (b) unjust enrichment, (c) fraud in the inducement, and other viable claims that may be related to your breach of fiduaciary duty claim.
