Health insurance

My health insurance company started double billing me(automatic withdrawal)shortly after I received my policy. I called them (8) times for the purpose of straightening out their error. My bank called them twice and they stated they would correct error. The automatic withdrawals stopped altogether(No Request Or Fault Of Mine) and I just received a letter stating that the insurer had terminated my policy (4) months ago. I was not informed that I did not have health insurance over this 4 month span and the insurer is sending me delinquent notices for premiums I do not owe.

My credit is now affected. I do not have health insurance and probably cannot get it because of this situ. My bank tried to rectify but insurer does not understand what they did and I get the feeling that two divisions of the same company are trying to get paid for one policy. I have tried everything to straighten this out to no avail. What can I do legally to make insurer liable for this situ.

Have you considered contacting your insurance commissioner? They may be able to straighten it out for you. Short of that, communications from an attorney might show them you are serious. Did they ever refund the money that was double-dipped? If not, an argument may exist that, in fact, they had sufficient premium payments to cover the four months. What are the terms of the policy as to termination? Usually there would be some kind of notice required so that you can cure or reinstate. There may be statutes that require notice as well.
