Legal Question in Civil Litigation in Florida

New home fiasco

What kind of legal remedies are available in a situation where a new home which was purchased from the builder has a defect which the builder has failed to remedy? In this case the property was so poorly graded that severe flooding continuously occurs. The flooding will get worse over time and will make it impossible to sell for an equitable price. The warranty has expired, although the warranty validation label was not sent to me until well after the warranty expired anyway.

Warranties can be expressed or implied. I have

often found in such cases that fraud or promissory

estoppel might apply. I strongly suggest you

seek the advice of an attorney immediately. The

longer you wait, the more difficult it will become

to seek any recovery.
