Legal Question in Civil Litigation in Florida
Ok. My husband at the time goes weird on me, gets into drugs and then leaves me for someone else and then moves to Alaska. About the time he gets caught by me doing this, I close all banking accounts. Two years later I have a Sherriff standing at my door with a warrant for my arrest for bouncing a check to Publix. I called Publix to find out what is going on. They said that I cashed a check for the grand amount of about FIVE dollars. Problem� I never chased any check at Publix. I asked Publix to give me proof that I cashed it. They did not. There was no photo ID checked nor a picture taken of the check and my ID. Nor was the signatures compared from any ID to the check. They did not follow their own check cashing procedures and I am being punished for something that I did not do. Publix basically said oh well, this is your fault anyway. Then come to find out after I was pulled over for a tail light being out just after I was arrested for this check, that my liscense is suspended. This lead to a ticket stemming from the checking incident. They suspended my license and I did not know about it. Went to court over that too. I now want to sue Publix because they did not follow their own procedures and I was wrongfully arrested for something that I did not do. What kind of attorney do I need to see? Under what statute does this aply? Has this ever happened before? Is there case law precedence? Any help would be great. Thank you.
