Illegal tattooing of 17 year old

What is my legal recourse of having the tattoo facility pay for the removal of the tattoos on my son. He went to the facility without permission and received tattoos. He did not give false information to that tattoo artist. I have paperwork that verifies that. Even though he informed the artist that he was 17 he still tattooed him. It is a misdemeanor in Florida to tattoo a minor. The tattoo facility does not want to pay for removal even though they agreed initially before they received the estimate of cost. I would like to take them to court to sue for the cost of removal. Thank you.

Pursuant to Florida Statute � 1.01(13) The word "minor" includes any person who has not attained the age of 18 years. You state that your son is 17 years old. Pursuant to Florida Statute � 877.04. entitled "Tattooing prohibited; penalty" tattooing a minor is illegal. Section 877.04 states in full as follows:

(1) It is unlawful for any person to tattoo the body of any human being; except that tattooing may be performed by a person licensed to practice medicine or dentistry under chapters 458 and 459 or chapter 466, or by a person under his or her general supervision as defined by the Board of Medicine.

(2) Any person who violates the provisions of this section shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

(3) No body of a minor shall be tattooed without the written notarized consent of the parent or legal guardian.
