Indemnification

I am secretary of our local homeowners assn. We are indemnified. What does that mean? I was told it meant we cannot be sued. We carry insurance for this. Is the insurance necessary? How does a group become indemnified?

You can still be sued.

However the homeowners association may step in and provide for costs of defense and possibly pay any damages awarded.

You need to review the indemnification clause in the HOA's by laws as well as the alleged insurance policy to determine what exactly is covered. You may wish to consult a local lawyer for peace of mind.
