Legal Question in Civil Litigation in Florida

invasion of privacy

A female friends picture and name was put on the internet about 4-5 yrs ago without her knowledge or permission. She is extremely upset. I did not ask the nature of the photo(s)and she did not volunteer, so I think it was very personal.

Anyway, she would like to take legal action against the person who did it. And she asked about any limitation on taking action on a subject of this matter.

Our advice is to let it go. Libel is a dangerous lawsuit that serves only to bring the issue to the public, when in most cases that matter is better of left alone. The measure of damages (how much money it's worth) is usually inconsequential, since it's usually impossible to prove money damages, unless she lost her job or otherwise was injured in a way that can be measured in dollars. Our advice is let it pass, i.e., at least don't file a lawsuit.
