Judgements

Dear Staff:

A judgement was entered against me in 1995 when a bank sued me for a loan that I was unable to finish paying during a lengthy illness at that time.

Since then this bank has been taken over by a much larger bank. Can the larger bank attempt to collect on this judgement, even though they were not the bank that originally sued me?

Yes. The new bank simply took over for the smaller bank, and now the new bank has all of the rights that the smaller bank had against you. As part of the acquisition of the smaller bank, it is very likely that the smaller bank assigned all of its interest in any judgments, claims or pending lawsuits against folks like you to the new bank, giving the larger bank legal authority to continue pursuing the lawsuit against you or allowing it to execute upon any judgment that was entered against you and in favor of the smaller bank.
