Legal Question in Civil Litigation in Florida
Hello, my name is Ken Babb.
The below facts are true. Please advise your opinion of successfully litigating
my interest. I would like to receive compensation for being 'sold' to the highest
bidder.
SunTrust Bank offered to bring my mortgage balance
current if I would pay them $5,000 and immediately began making timely payments. I accepted the offer (verbally) and talked to SunTrust�s representative
several more times concerning same. The SunTrust representative stated that the forms would be mailed. Time passed and I received no forms. Contact was made with
the SunTrust representative and again she checked her information on her computer. She agreed that the forms should have already been received by Connie and me.
She stated that she would contact the proper department and make certain that the
Docs. were sent as promised. Again we contacted the SunTrust representative and again she checked her information on her computer. Again, she promised
to get the forms to us. (actually the rhetoric between SunTrust and Connie/me became very extensive).
THEN ALL FELL SILENT. We could not even get a return call from our SunTrust�s representative. Soon after, we received a letter
from Liton stating that they had purchased our mortgage. I provided all financial information requested by Liton. Ultimately, Liton stated that I had not purchased my home
prior to �some� eligibility date cut off. I assured her I had. She checked her information and then stated that the real reason we were turned down for a mortgage adjustment was because i
make too much money...The Liton representative then gave us the name of a company that (the Liton representative said was less financially stringent) may possibly reduce our payment. When we contacted said suggested company, the representative laughed and said that I did not make enough money to afford my mortgage. Liton will not make any concessions and fully intends to foreclose.
I invested $150,000 cash in the home. My wife and I are 61 and 62 years old. I need not explain to anyone the impact of the trauma concerning being thrown out of my home. Not to mention
the loss of the original $150,000 investment.

Hello Ken,
I go to court every week with foreclosure defense issues such as this. It is not uncommon for borrowers to get the "run around" from lenders. This is one of the reasons that this country is in the financial mess in which now we find ourselves.
You need a real estate foreclosure law firm that can review all of your documents and advise you as to your rights under the law. Don't start packing your bags yet, it takes months if not years for a foreclosure to come to completion. As for being "sold" to the highest bidder, lenders are generally free to divest themselves of your loan to any taker. But that lender is governed by the same laws.
