Is it legal to videotape customers without notice?

My neighbor went to a small UPS center to mail something anonymously to someone. Nothing illegal, just some information she had pertaining to a notice in the paper seeking information. The store videotapes and keeps on file all people in the store. There is no notice of this anywhere inside or outside the building. She found out that the people that wanted the information, plan to suponea the video tapes to see who may have sent it to them.

Is it legal to videotape customers of a retail establishment without putting a notice on the front of the building that they are being videotaped? If it isn't legal can the store turn over the tapes without the customers permission?

Video recording customers in a store and using the videotape as evidence is legal since: (1) there is no "legitimate expectation of privacy" and (2) since video tape recording, as long as not edited, is acceptable in courts.
