liability for accident in company vehicle

I was traveling in my company vehicle, towing a trencher, on the interstate when the trailer started to sway back and forth. I tried to tap the brakes in order for the trailer brakes to straighten the vehicle back up. That did not work. I then tried the overide lever for the trailer brakes, which also did not work. This continued to happen until we lost control, hit the guard rail head on and rolled one revolution landing on tires once again. Two days later i went and got checked out, and gave a urine sample. I had marijuana in my system. I did smoke pot the day after the accident, but the test was the next day. (I assumed I was fired after the accident, so what would it matter) I am now being sued for the cost of the truck, trailer and trencher, on the basis of driving while illegally intoxicated. The test was not done immediately after the accident. So my question is, do I owe them this money? I was NOT impaired, I have had three different helpers during my employment that worked with me all day long and none of them could ever say that they ever seen, smelled or even thought that anything like that from me.

It will be for a jury to decide. Suggest you retain counsel familiar with accident cases. Good luck.
