Legal Question in Civil Litigation in Florida

Liability

Can I hold my neighbor liable for damage done to my property by his guests? Frequently, his party guests are backing over my mailbox late at night (no one sees it happen). I don't know who does it, and he says he doesn't know who did it, but it is obvious from the damage that it is definitely someone backing out of his driveway.

Re: Liability

Maybe, but your case would be pretty thin. You'd have to prove your neighbor was negligent in allowing people to run over the mailbox. Just having a party probably isn't negligence. The real person to sue, of course, is the one who did it, so, next party, be on guard or set up a camera.

And when you find out who it is, contact his auto insurer and they will pay the damage.
