In 1996 my daughter and I were robbed at gunpoint in our room at a hotel in Jacksonville, FL.
I let the statue of limitaions run out because of the ''Impact Rule'', although I suffer from PTSS as a result of this robbery. My intention for suing in the frist place was to force the hotel chain to offer better security. With increased acces to the web, I would like to post my story online, but I am an educator in FL and a single parent whose daughter attends NYU, I could not afford any litigation by the hotel chain. My story is graphic, but truthful, I just want to make people aware that all is not safe, even in an upper end hotel chain.
Can the hotel chain sue me if I post this story?

Yes, the hotel can sue you if you post your story. The good and bad of the American judicial system is that anyone can easily access it to file a claim or lawsuit against anyone else. Of course, the plaintiff or party filing the suit will have to prove its allegations, but even if the claim is bogus, the person or party sued is generally forced to defend the claim and incur the expenses associated with such defense. I do not have any knowledge regarding your story, and I do not know if what you intend to publish may serve as a legal basis for the hotel to file a viable claim against you. You have to consider and weigh whether or not posting your story is worth the risk of opening yourself up to potential liability to an entity with deeper pockets than you. Sadly, you must weigh this question even if you have every right to publish the plain, truthful facts about what you experienced. Perhaps there is a way for you to publish your story without revealing your identity, but still fulfilling your purpose. Good luck.
