marital

My husband is emotional and verbally abusive. I want to legally separate, but he won't leave the house. If I leave, will I be abandoning the residence?

Abandonment is not a claim in a divorce as Florida is a No Fault state. It does not matter if one party has left the marital residence. Your rights to any property, including the residence, will not be compromised. All the petitioner has to say is that the marriage is irretrieveably broken and a divorce will be granted.
