Legal Question in Civil Litigation in Florida

monetary damage-loss of use

My sailboat was yanked from its' paid slip 11 months ago by the marina for alleged money I owed. The marina now admits I owed them nothing. My lawyer says I can get nothing for my loss of use. ''how do you put a dollar figure on it?'' says he.

'How do they put a dollar figure on lack of consortium?'' say I. Is there case law I can cite to my lawyer to convince him (and a judge) that I should be awarded money damages for the 11 months (and counting) my property has been converted by the marina?

Re: monetary damage-loss of use

You have the loss of use that can be measured by the reasonable rental value the same as with an automobile. You may also get punitive damages measured by the assets of the Defendant.
