Legal Question in Civil Litigation in Florida
The other night me and a friend was pulled on to the side of the road because my truck was overheating.A man pulls up behind us so I asked him if he had a water hose nearby or if he could help us.At this time,he pulls a gun on us and says that we don't belong here,threatens us repeatedly,and then makes us stand in one spot until the police arrived.When the police got there,we were questioned and we told them what happened.They took his bullets and that was it.He admitted to the police to pulling a gun and false imprisoning us.Regardless of what this man thought,he had no legal right to pull the gun,point it at us and make us stand in one spot while he threatened us.He was not arrested but a police report was filed against him.I find out the next day that this man is a millionaire owning several patents.Can I sue him for illegally assaulting us with this gun,threatening us and false imprisoning us?We were not aggressive in any way,did not step foot on anyone's property and were not doing anything wrong like he assumed.I am still very shaken up by this.Just because he has money does not give him the right to play cowboy.So can I sue this man?

yes, you can sue him. get a copy of the police report first to make sure what is recorded as happening.
Yes, if what you say accurately portrays what happened, you can sue for assault, maybe battery and false imprisonment. You might also be able to sue for intentional infliction of mental distress. You may be able to collect punitive damages as well.
No, money does not give him a right to play cowboy. Be upset, loud, and mean -- but at the end of the day, get an attorney. There is a valid civil suit here.
