Legal Question in Civil Litigation in Florida
What does notice of intent to dismiss s/hayes means?
1 Answer from Attorneys
In most cases when a Notice of Intent to dismiss is filed in Florida is means that there has been no activity on a case for a long time and the court is threatening to dismiss if no one takes action. If no one appears at the hearing to explain why the case should continue, the court will dismiss. Normally, whoever filed the case would lose the filing fee and have to pay again if it is re-filed. The specifics and procedures depend on whether your case is in civil court, family, probate, bankruptcy, or workers compensation court. You should consult with an attorney immediately.
