What are my options for getting my car back?

I bought a car with my girlfriend (now ex) and both our

names are on the title. When we broke up she moved

and took the car with her. I am the primary and am still

making payments but have not even seen the car for

over a year. I now understand that she is not even

driving it, but her new boyfriend is. I don't want him

driving it and would like to get it back to re-sell. What

are my options? I don't even think she has a valid

liscense and she doesn't pay any insurance. Can I

declare it stolen? She is not even in state right now

and he is driving it. Please advise.

You own the car, so you can go get it. It is not stolen becasue she also owns it.

It is not stolen since your ex gave it to him. You certainly could sue them to quite title to the car. Since you are making payments you are the equitable owner. The judge can order delivery of the car to you and/or money damages.
