someone owes me 16k they are going thry foreclosure now what can i do to collect my debt?

Not enough info. Do you have a contract? Are they delinquent in payments? Did they have a time frame for repayment or to pay "when they can"? If they are delinquent in paying, and no other arrangements have been made, you can sue them. Look at the clerk of court website for your county for instructions and forms. After a judgment in your favor, you do not usually walk out of the courthouse with a check for the judgment, especially when the defendant has no ability to pay. The next step is to enforce the judgment. If this is making little or no sense to you, I strongly recommend you retain an attorney to help you.

You will need to enforce your rights by filing a lawsuit in the event the debtor does not voluntarily pay back the debt. After you obtain a judgment you will need to enforce the judgment against any available assets of the debtor.
