Legal Question in Civil Litigation in Florida

Another party $6,000 from me in 2008. They have not paid anything back accept recently a $50 payment because they think I am going to sue. Can I still sue them even though they have made this one payment? I have proof I loaned the money. And I think I deserve to be paid more in installments than $50 a month if that is what they are attempting to do. Also, what is the interest rate in Florida on a loan like that?

What does your agreement say about interest and payments? You should have put this agreement in writing. I think you need to communicate with the other person. If you two can agree to a payment plan at a monthly amount you can live with, then put it in a contract that you both sign. Then you sue if they fail to make payments as agreed. You can charge up to 18% interest under Florida law. For more help, contact an attorney.

Yes, you can sue. The interest rate depends on what your agreement was when you lade the original loan.
