what is a pattitioners role in a civil suit. does it matter who does it

The Petitioner is the person who files the suit. If the Respondent files a counter claim or other claim then the Petitioner can become a Counter Respondent. There are some logistical advantages to being the Petitioner, but generally if both sides file claims then there is no difference as to who files the lawsuit.
