Legal Question in Civil Litigation in Florida

pensions

in 2006 at age 63 i took a lump sum distribution from the company that i left back in 1996 from the company paid pension plan.

in 1996 when i left the company i took our all of my 401 k in a lump sum.

they are now telling me that they over paid me on the pensions plan by 12,064.31 dollars, which is that amount of the 401k that i took back in 1996.

they want this paid right away, i do now have that kink of money as my only income is social security at 800.00 per month. I am unable to work because of bad heart and a damaged lung.

what can i do, and what are the legal actions that can be taken against me in this matter.

please help me. thanks

I would try to work out some sort of repayment plan with the company. Explain your financial situation and lack of funds. Frankly, if you have no savings, they cannot garnish your social security payments anyway.

If the company will not accept payments, then you may as well let them get a judgment against you. Your social security payments are safe and you say that you have no other monies.
