Legal Question in Civil Litigation in Florida

Property Legalities

I own a lot in Florida with my brother and sister. It is deeded to all three of us. My brother wants to build a house on it. What are my concerns?

Re: Property Legalities

You are asking for trouble. Generally, if i recall my real property law correctly, a house becomes part of the property (unless it is a trailer, that could be moved). When it becomes part of the property, it probably becomes part yours. You'll need some agreement or understanding about who will use the house and when and who pays for it. Building a house will also create a higher tax bill.

This is about to open a can of worms. You should probably all sit down and agree to some equitable way to share expenses of building the house and paying expenses or those that do want to build should buy out those that do not.
