Protecting one's home

My husband and I entered into this discussion...but actually don't know the true answer...maybe you can help....

Senario: Someone breaks into our home, we-in an attempt to protect our lives and home-shoot him, but not take his life....Can he sue us in a civil suit? My husband says yes and this person would win.....I say no he can't cause he shouldn't have been breaking in our home in the first place...

What the true answer?

He "can" sue; however, if it is as you describe it, he doesn't have a prayer of winning. +Now, if you chased him down the street, caught him, held him down and shot him -- well, that is a different matter.
