Legal Question in Civil Litigation in Florida
Ok heres my questtio.I was ecently living in a apatment in a sober living community and i came home from work the other day after living there 8 days without any incedences and i was imeidatly accussed by a very aggresive manager of the aprtments who accused of being high.I was totally shocked at his aggresive behavyour and the aqccusation i have been compleatley drug and alcohl free for 90 days.Anyway my response was that i wasent and i would gladly take a urine sample right now he said that he didnt need a urine sample and he new every time when someone was high and i had to get my stuff and leave i kept insisting that he give me the urine sample and after the 10th time of asking he reluctuntley agreed which i did and then something very strange happened he grabbed the test as it was changing color and ripped it up and said i was high on cocaine and to get my stuff and get out,by this time it was 11 oclock and no where to go and no money so i asked for my $300 deposit back he said i had breached the contract so i wouldent be getting anything back by this time im becoming extremley aggitated.So i ended up on the street all night with all my stuff and no where to go.I called the owner to tell her what had happed and she said tony was always right and i wouldent be getting my money back because i failed the test i asked her to produce that test and show it to me and aalso that i wanted to take another test that we could see nothing happened.Anyway ive found a new sober living envioroment but its all round this new place that i caught using drugs where do i stand legally on the unlawfull eviction the theft of my deposit and remain rent days and the one that has been worst of all the slander that now everyone is talking about.Im outraged and determind to that im not letting this lier get away with this i dont care what it takes i will do what i have to do to expose this guy who is supposed to caring for vureable people and blatently lied just so he didnt have to admit that he made a mistake.Please help me i feel like a small fish in a pound of pirrannas right now.

You need to look to the unique terms of your lease. All terms of drug testing, mandatory sobriety, and eviction will be in the contract you signed. Absent circumstances you have not stated here, you should be able to get back your security deposit. I am happy to hear that you found a new, stable place to live.
