Legal Question in Civil Litigation in Florida

I received a car from my boyfriend for a Christmas gift. We have since broken up and he is threatening to take it back. Can he do that?

Whose name is the car titled in? If it is in his name, than he might be able to get it back. If he titled it in your name, than it would come down to an argument about whether it was intended as a gift or a loan of some sort. You probably want to speak with any attorney if he actually tries to take back the vehicle from you.

Although it was a gift, it really does depend on whose name is on the title of the vehicle. If he's on the title and he paid for it, there is a presumption that the car is his. If you are on the vehicle's title, then he cannot just take the car. Contact an attorney for additional assistance. Regards,
