Legal Question in Civil Litigation in Florida
i have received a summons to appear in a pretrial mediation ins mall claims court. The plaintiffs are represented by a lawyer and they are claiming damages of between $2500 to $5000 to a condo unit that is right under a unit that I own in the same complex. They claim the damage occurred in Nov 2009 due to a water leak, and i was not served until August 5th, 2010 At no time before this have they tried to contact me to tell me that any damage had occurred! What recourse do I have

Your recourse is to file defenses to their claim and to make sure you show up at the pretrial mediation.
Go to the mediation to determine the merits of their claim. If they have a meritorious claim, try to work it out. Make sure you are careful about what you agree to and sign. You do not have to settle at mediation. If claim against you is false, fight it. You will need to file an answer to the complaint and prepare a defense.
