going off the record

a single attorney can order a deposition to start, but do both attorneys have to agree to go off the record?

You mean, in a deposition? There's no rule on it. Once or twice, I've had opposing counsel attempt to go off the record, and I've refused, but the circumstances were pretty extreme. The court reporter will probably not go off the record unless both parties agree.
