Legal Question in Civil Litigation in Florida

Removing Tree Limbs on Split Property

A tree on the property line falls 3/4 on my property. The remainder is on the neighbors property. A branch hangs over her roof causing squirrels to jump on her roof and annoy her. She wants me to remove the branch. She fertilizes this tree regularly on her side as well as having placed a garden beneath the tree on her side surrounded by rail road ties. She did not ask our permission to do any of that but now wants us to remove the branch. What is the law regarding shared trees? Or is there a clear way of know ''whose'' tree it is? Thank you.

Re: Removing Tree Limbs on Split Property

If the branch she wants to remove falls on your neighbor's side of the property, it's your neighbor's responsibility to remove the branch, not yours. Tell your neighbor that she is free to trim whatever part of the tree falls on her side of the property.
