Legal Question in Civil Litigation in Florida

Renter

I rented an apartment for my daughter and granddaughter - the apt is in my name and the deposit is in my name also. My daughter moved out to get her own apt. leaving the grand daughter there. She asked an person to move in to cover 1/2 the rent. He moved in one month ago - they had a disagreement and my daughter moved out. He said he would take over the apt. He stopped payment on his 2nd months rent. He wasn't seen at the apt. for over 10 days. I called my landlord and told the apt would be available 4/1/07. I paid for a cleaning service to come and remove the furniture and junk left in the apt. He shows up this weekend asking where his things are - gone with cleaning service. He starts giving me a little mouth. Told him to leave - his mother called me and said she was hiring an attorney. It was my understanding since he stopped payment on the rent and didn't remove his items he was interesting in living there. What is my responsible. I had to pay the 1/2 rent he stopped payment on and cleaning service, carpet, and painting to re-rent the apt. I have also spoken with my landlord and he just wanted the apt cleaned for renting.

Re: Renter

This issue is complex and depends on certain facts. Generally, the courts to not long fondly on self help andf require proper cancellation of the tenancy.

Retain counsel. Good luck.
