Legal Question in Civil Litigation in Florida

Repayment on money during my divorce

2 yrs ago I went through a divorce. During that time I borrowed money from my parents for house payments, auto loan, child support & lawyer fees. I paid my parents back mostly in cash but also with checks. My parents are now saying that I did not pay them back & that I owe them over $14,000.00. Is there a statue of limitations on this debt? Also, I believe that I have paid in full but I did not keep any records. Since there was never a signed agreement between us can they take me to court to get paid this outrageous amount I supposedly owe them?

In lorida the statute of limitations on the breach of an oral contract (loan) is 4 years. Five years on a written contract. Yes, they can take you to court. It would be their burden to prove the contract and your failure to pay and your burden, after proof of the contract, to prove what you paid.
