Legal Question in Civil Litigation in Florida

residential property owner dispute tree trimming without consent

the property owner behind me has put a chain link fence on my property by 2.5 ft., planted on my side 3.0 ft from fence is a hedge 27.0 yrs old that has been left alone for the period. it's hugh like trees and was a good buffer between lots. he cut all of this hedge to pieces without permission from me. he said because it hung over this fence he put up which is totally on my property by 2.5 ft. so even if the hudge branches hung over that side it is still within my property. is there a course of action i can bring against that property owner and how. thank you

What is the fence doing on your side of the property? Did you give him permission to put it there? If not, then you should speak with an attorney. The fence is tresspassing on your property. If you do nothing, in several years time you may lose ownership of the land located on the other side of the fence. This is called "adverse possesion".

The shrub is the least of your problems.
