Legal Question in Civil Litigation in Florida

My scooter was improperly towed off my aparment complex. The tow company is claiming that someone who works at my apartment comlpex called to have it removed because it was abandoned which is untrue. My plate was expired;however, after speaking with the managers off the apartment complex, I was told that they never called a tow company to take it off the property. The managers are willing to write a statement confirming this. The balance due for my scooter exceeds its value. What steps must a take to win this case?
