Slander

A friend's father has recently been accused of lewd and lascivious conduct on a minor under the age of 12. He has not been convicted yet but the charges have not been dropped.

Recently, the neighborhood that he lives in has been putting up flyers of his mugshot saying ''Stay Away Kids! He's Our Neighbor!''

Does this fall under a public defamation of character considering the stipulations in effect currently? (I. E.: Being charged but not convicted of it. No real sound evidence that he did it.)

If what is posted is factual -- i.e., he has been charged, then that is fine. If what is being posted is that he is a molester, then that is wrong.
